Terms and Conditions
This section sets out the Terms and Conditions under which Shadytree Books (“STB”) agrees to provide services to you and your child (“You”).
Please note that we amend these Terms from time to time. Before making a booking, please check this page to ensure you understand the Terms which will apply at that time. These Terms were most recently updated on 6 June 2018.
1. General Policy & Procedures
1.1. STB will provide tutors and coaches to deliver educational programs, including after-school, in-school, and holiday programs.
1.2. STB reserve the right to replace tutors or coaches at any time.
1.3. Workshop dates will be announced via the STB website, Facebook Page, newsletter and any additional marketing channels.
1.4. All materials provided by STB to you, remain the intellectual property of STB.
1.5. It is Your responsibility to alert STB of any medical complaint suffered by Your child or yourself as a participant of a workshop or service provided by STB.
1.6. STB maintains a comprehensive Public Liability Insurance policy, a copy of which is held at STB’s office.
1.7. All teaching, staff of STB maintain up-to-date Positive Blue Card and Criminal check certificates.
1.8. STB does not accept responsibility for the loss of, or damage to, personal belongings, including valuable items, brought onto the premises. STB will not be responsible for any items left at the venue by the student or You and may dispose of any such items if not claimed and collected by you within seven days of the end of the workshop/course.
1.9. STB cannot be held responsible for accidents or injuries that may occur as a result of children tripping, falling or bumping into other children during workshop hours.
1.10. STB cannot be held responsible for supervision of your child and do not accept liability for any loss, accident, or injury that may occur prior or after scheduled workshop times. This includes outside space at the premises if available.
1.11. This agreement is governed by Qld State and National Laws and any dispute will be dealt with under the exclusive jurisdiction of the courts of Qld.
2. Bookings & Payment
2.1. Upon completion of your order online or otherwise on a signed registration form, a contract will exist between You and STB.
2.2. Workshop fees, tutor fees, picture book boot camp or manuscript assessments must be received in full prior to the child’s attendance or commencement of work.
2.3. You may transfer your paid booking to another person with no additional charges to be paid. An application/registration form will need to be completed by the new client before the commencement of the workshop/course or we may refuse the enrolment.
2.4. There is an administrative charge of $20 where a cheque is returned unpaid by your bank.
2.5. If for any reason you are unable to submit your booking via our web booking system, regardless of payment method chosen, a 10% administrative fee (up to $30) will be added to your order.
3. Cancellation and Refund Policy
3.1. If You miss any workshop/course for one or more days, no refund is available. At the sole discretion of STB, and provided you notify us with 48 hours notice prior start of the programme, You may be offered a make-up session if you miss one in term-time. Make-up sessions are not available for holiday or after school session. If you miss a tutoring session, at the sole discretion of STB, and provided you provide us with 12 hours notice for (medical only) prior to start of tutoring session, a make-up session may be offered to be completed in same week or following week. If this is not achieved, the missed session will be forfeited with no refund.
3.2. In the event of cancellation by You. If You are unable to attend a workshop/course, You should inform us in writing as soon as possible, as cancellation charges apply dependent on notice given. A cancellation is only valid when it has been received and acknowledged in writing by STB.
3.2.1. If you cancel your booking 30 calendar days or more prior to the commencement of the workshop/course then you are entitled to a refund less a 10% administrative fee (up to $30), with a limit of one refunded booking per year. STB will not be liable for any charges incurred by you when sending a refund.
3.2.2. No refunds will be issued for bookings cancelled less than 30 calendar days prior to the date of the course/workshop. Credits are not available for missed sessions or cancelled bookings.
3.3. In the event of cancellation by STB. On occasion, unforeseen circumstances or where the number of bookings does not reach the minimum required to operate the program, may require STB to cancel a workshop/course or move you into a different session. Under these circumstances, You will be given as much notice of the cancellation as possible in writing and either a transfer to another date or venue or a full refund of fees paid will be offered.
4. Tutoring Sessions – Packages
4.1. Tutoring Sessions are sold as Packages (a minimum package of 4 weeks or by Term, 10 weeks) and are to be used weekly, or more frequently, from an agreed start date for maximum benefit to the student. Packages must be paid ahead of time and before sessions start.
4.2. Our tutor/s will provide high quality and consistent support to students enrolled in Shadytree Books’ Tutoring Program, but the degree of successful results will be dependent upon each individual student. Shadytree Books can ONLY guarantee responsibility to provide high quality support. Whilst we would expect students to make improvement, and every effort is made to engage and support each student, it is not possible to guarantee what levels of improvements are reached.
4.3. Withdrawal from Tutoring Sessions – a minimum of two weeks’ notice is to be given when discontinuing tutoring sessions.
5. Change of Programme
5.1 We will make every effort to deliver the program as advertised at the time of Your booking, but we reserve the right, without liability, to change the specifics of the program where circumstances beyond our control necessitate such changes. Should circumstances beyond our control dictate changes, STB reserve the right to make changes to all services provided including, but not limited to, the course program, teachers, locations and will promptly notify you in writing.
6. Student Behaviour
6.1. Your child will be expected to behave appropriately, showing respect to property and fellow students. Disruptive behaviour, bullying, or aggressive attitude towards other students, parents and STB staff will not be tolerated.
6.2. STB reserves the right to refuse admission at any time or to remove any student whose attendance or behaviour is deemed unsatisfactory. Under such circumstances, STB will be under no obligation to return any fees.
6.3. No food, sweets, nor drinks apart from still water will be permitted in the carpeted areas. No chewing gum is allowed in the premises.
7. Health and Medical
7.1. Before we can accept your child as a student, it is your obligation to give us information and instruction regarding their healthcare and medical needs. We accept students on the assumption that they are in good health, unless otherwise stated in the registration form. It is your responsibility and obligation to tell STB prior to the start of the programme of any issue or condition that may affect your child, including but not limited to: ADHD, ASD, SEN, speech and language difficulties, disabilities, food allergies or other medical condition, behavioural or social issues.
7.2. If your child joins our programs with a medical or behavioural condition that we did not know about, we reserve the right to remove your child from the program, if it is determined that we do not have the resources to meet your child’s needs and safeguard them properly.
7.3. In case of medical emergency, STB staff will call 000 for assistance and then call parent/custodian.
8. Force Majeure
8.1. STB shall not be responsible for any delays in performing, or for any failure to perform, any of our obligations if the delay or failure was due to any cause beyond our reasonable control including, without limitation, war, strikes, governmental regulations or orders, national emergencies, terrorism, lock-outs, fire, flood, drought or other natural disasters.
9. Property Rights and Use of the Website
9.1 Unless otherwise stated, we own the intellectual property rights in the website and material on the website. All our intellectual property rights are reserved. You may view, download and print pages or other content from the website for your personal use. You must not reproduce, duplicate, copy, sell, resell, or otherwise exploit our website or material on our website for a commercial purpose, without our express written consent. 10. Changes To This Terms and Conditions
10.1 We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

I assume full responsibility for any injuries or damages which may occur to me, or my child, using the studio facilities and equipment, and hereby fully and forever release and discharge Shadytree Books, its owners, employees, and agents from any and all claims, demands, damages, rights of action, or causes of actions, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting or arising out of my or a member’s use or intended use of the facilities and equipment of Shadytree Books premises. I warrant, represent and agree that I am, my child is, in good physical condition, and have no disability, impairment, or ailment preventing me from engaging in active or passive exercise that will be detrimental to health, safety, comfort, or physical condition if I do so engage or participate. Shadytree Books shall not be liable for the loss or theft, or damage to, the personal property of a guest or member.
These terms and conditions are governed by and construed in accordance with the laws of Qld, Australia. Any disputes concerning this website are to be resolved by the courts having jurisdiction in Qld, Australia.
We retain the right to bring proceedings against you for breach of these Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

Refunds & Credits
If Shadytree Books must cancel an event, we will try to reschedule it for a later date. If we cannot reschedule the event, or if you are unable to attend on the amended date, your payment will be refunded in full. Shadytree Books does not refund events, workshops or tutor sessions for changing mind.
Except in special circumstances, if you cancel a booking for, or are unable to attend an event, workshop, seminar, or course, Shadytree Books cannot provide a refund. In exceptional circumstances we may be able to offer you a credit for an alternative event or program. Credits must be redeemed within three months of issue or at a later date at Shadytree Books’ discretion. You can contact us here to discuss.
